They are super predatory and legally binding, and you or me could technically be in debt for billions of dollars and not know it. In one instance I remember that one of the terms was that you literally had to agree to give your soul away to the developer. They could just add anything in there because it's not like anybody reads through it. If they are designed to be ignored and realistically almost never enforced, then maybe they shouldn't exist in the first place?

that's why we have restrictions for contracts in the eu. if it contains a point that is higly unusual that point doesn't become part of the contractI bought a game on steam from 1995, intending to mod it in order to make it playable in the big 26. Guess what? Modding this snca game from 31 years ago is against the terms and conditions that you are forced to agree to in order to install the game, and violating this term would make me immediately legally liable for the "damages" incurred. This is but one example. Pretty much every service and application nowadays - offline or online, with very few exceptions - tends to have these kilometric EULAs that full of dense legalese and contain hyperlinks to other pages full of dense legalese. Not only that, but they get updated multiple times every month, never to your benefit.

That doesn't really help at all thoughie. The norm is that these EULAs are maximally extortionate, just go to the liability section of any eula and be horrifiedthat's why we have restrictions for contracts in the eu. if it contains a point that is higly unusual that point doesn't become part of the contractShow quoted text

The issue is not whether they're enforced or not, it's that they exist in the first place. EULAs should be replaced with standard legal protections that apply to all consumers and developers/service providers. Easy. Or, introduce a select number of icensing templates which the developer can choose to apply to their product. No more custom licenses.99% of the time they don't enforce them for individuals, and if they do it's to scare cheat developers into complying, though these days they just buy them out.
